Rules Enforcement and Disciplinary Actions

1.0 Purpose:

1.1 To establish penalties for non compliance to Grandview Lake Safety rules, regulations, policies and procedures.

2.0 Definitions:

2.1 Boat: Motorized or non-motorized watercraft, including but not limited to boats, kayaks, canoes, paddle boats, sailboards, jet skis, ice boats, snowmobiles, any of which is hereinafter also referred to in the Grandview Lake policies, procedures and work instructions as “boat”

2.2 GLOA: Grandview Lot Owners Association – To contact the Grandview Lake office call 812-342-1219 or email gloa@grandviewlake.org or stop by the office at 5150 S 650 W Columbus, In 47201-8813. Office hours: Monday through Friday 1:00 PM To 5:00 PM

2.3 Lake Safety: Lake Patrol personnel, Grandview Lake Safety Chair, or any member of GLOA BOD.

2.4 Violations: Any disciplinary action taken resulting in a loss of lake privileges also applies to the lot’s guests.

2.5 Lake Safety Chair: GLOA BOD member representing water safety.

3.0 Enforcement of These Rules and Regulations

3.1 Neither the BOD, the Association, nor the Lake Safety Chair shall have the sole responsibility for enforcement of these rules and regulations. It is the responsibility of all lake users to help and aid in the enforcement of these rules and to assist in improving the safe enjoyment of the lake.

3.2 The owner(s) of each lot on Grandview Lake shall inform all those persons who shall use or operate any boat on Grandview Lake belonging to such owner(s) or that is registered to such owner’s(s) lot of the Grandview Lake Rules and Regulations, and shall be responsible for the use and operation of any boat on Grandview Lake that is registered to such owner(s) so that it is operated or used in compliance with the Grandview Lake Rules and Regulations. The BOD shall have the right to suspend the rights of any lot owner, renter, and their guests to use of Grandview Lake for any period up to but not to exceed six (6) months during a period of time as established by the BOD if such person violates any of the Grandview Lake Rules and Regulations. a) Lot owner: The BOD shall also have the right to suspend the rights of any lot owner(s) and their guests to use Grandview Lake and/or the right to suspend the operation or use of any and all boat(s) on Grandview Lake belonging to such lot owner(s) and/or registered to such lot owner’s(s) lot for a period up to but not to exceed six (6) months during a period of time as established by the BOD if any person violates any of the Grandview Lake Rules and Regulations while operating or using any boat on Grandview Lake belonging to such owner(s). b) Lot renter: The BOD shall also have the right to suspend the rights of any renter(s) and their guests of a lot on Grandview Lake to use of Grandview Lake and/or the right to suspend the operation or use of any and all boat(s) belonging to such renter(s) and /or registered to such renter’s(s) leased lot for a period up to but not to exceed six (6) months during a period of time as established by the BOD if any person violates any of the Grandview Lake Rules and Regulations while operating or using any boat on Grandview Lake belonging to such renter(s).

3.3 As used herein, the term “boat” shall include any type of boat, watercraft, personal watercraft, Jet Ski, canoe, rowboat, sailboat, sailboard, iceboat, and snowmobile. As used herein, the term “Grandview Lake Rules and Regulations” means the Grandview policies, procedures and work instructions as have been adopted by a majority vote of all lots fronting on Grandview Lake with each lot being entitled to one (1) vote, or as may be hereafter adopted, amended, or revised by a majority vote of all lots fronting on Grandview Lake with each lot being entitled to one (1) vote. As used herein, the term “BOD” shall mean the Board of Directors of the Grandview Lot Owners’ Association, Inc. As used herein, the phrase “use of Grandview Lake” shall include operating or riding in any boat or being towed by any boat on Grandview Lake.

3.4 The BOD, the Association, the Safety Chair, or any other lot owners or persons who are concerned with the writing, enforcement, or management of these rules are not in any way responsible for property damage, loss, theft, personal injury, death, or other problems associated with the use of Grandview Lake, and all persons using the lake, launching area, and dam do so at their own risk and responsibility.

4.0 Disciplinary Actions for Lake Safety Violations:

4.1 VERBAL WARNING: A verbal warning may be issued for a lot’s first (1st) violation each year. The verbal warning will be recorded with violator’s name and lot number.

4.2 FIRST and SEVERE INFRACTION: If a violation has caused a possible life threatening issue or if Lake Safety deems the infraction requires a written warning or other disciplinary action, then a written warning may be issued, along with other measures listed below, and may require an appearance before the GLOA BOD and can result in suspension of lake privileges for up to 6 months.

4.3 WRITTEN WARNING: A written warning will be issued for a lot’s second (2nd) violation (and all subsequent violations) in accordance with the lake Safety Violation Procedures Letter. a) A written warning will also require the lot owner and/or the person the infraction is against to come to the Grandview Lake Office located at 5150 S. 650 West, Columbus, IN during office hours, or other predetermined time. They must come with their lot’s copy of the Lake Safety Video that has been . Page: 3 distributed in the Spring of 2010. Failure to bring the copy of the video will result in the lot owner having to purchase another copy at $5.00 each. The lot owner will then have to watch the video and take a 15-question test on the rules of Grandview Lake. They will be allowed to only miss 4 answers to successfully pass the test. If they fail to pass, they may elect to watch the video again and retake the test or lose all lake privileges for 7 full days starting immediately. b) This first written warning could also result in an appearance before the GLOA BOD, and can result in suspension of all, or a portion of lake privileges for up to 6 months.

4.4 SECOND WRITTEN WARNING: If a second written violation occurs in the same year, all of the above measures will take place again, plus a mandatory meeting with the GLOA BOD. A loss of lake privileges may occur at the discretion of the BOD. The lot owner will also need to have a written “Plan of Action” on how he/she intends to educate their guests on the Lake Safety Rules.

4.5 THIRD WRITTEN WARNING: If a 3rd written violation occurs in the same year, all of the above measures will take place, plus a mandatory 1-6 months suspension of lake privileges.

4.6 FOURTH WRITTEN WARNING: If a 4th written violation occurs in the same year, all of the above measures will take place, plus a mandatory 2-6 months suspension of lake privileges.

4.7 The GLOA BOD has the latitude to suspend either the person who incurred the infraction or any and all of the owners of the lot, and their guests or the entire lot’s privileges with any of the above disciplinary actions.

4.8 If multiple violations occur at the same time (one stop by Lake Patrol) the violations may be grouped together as one violation at the discretion of Lake Safety.

4.9 Sample Violation Letter: TO: ____________________________________________, Owner(s) of Lot # ________ FROM: Board of Directors of The Grandview Lot Owners Association, Inc. (“Board”) RE: Violation of Grandview Lake Rule(s) DATE: ____________________________ A watercraft from your lot was cited by the Lake Patrol or observed by a GLOA member on (date) _________________, 201____, for violating the Grandview Lake Rules and Regulations. The violation cited was: Page No. ______, Section No. ______, Rule No. ________, as it appears in the Lake Rules and Regulations. on (date) _________________, 201____, for violating the Grandview Lake Rules and Regulations. This letter is to notify you officially of the violation and to request that you take action to make sure that neither you nor any operator of any watercraft registered to your lot violate any rules in the future. Since documented violations involving watercraft registered to your lot are numerous enough or serious enough to warrant review, the Board will conduct a hearing to determine whether to suspend the rights of all owners of your lot to operate or use any watercraft on Grandview Lake pursuant to Section 8 of the Grandview Lake Rules and Regulations. You and all owners of your lot as well as the operator of the watercraft who committed the violation are requested to attend the hearing. The hearing will be held on _____________________, 201___, at ________ p.m. at the administration building located at 5150 South, 650 West, Columbus, Indiana. If you cannot attend and if you desire to request another hearing date or time, you should immediately call (812) 342-1219 to make this request. The Board may or may not grant this request. The Board requires there be no future violations by any operator of any of your watercraft. Any future violations could result in loss of lake privileges for an extended period of time to be determined by the Board. Safety on the lake is an absolute priority for the Board, and it is every lot owner’s responsibility to ensure that the Lake Rules and Regulations are observed. Failure to abide by the rules could result in property damage, serious personal injury, or death. Please review carefully the Lake Rules and Regulations and discuss them with each family member, guest, renter, or anyone who has permission to operate watercraft registered to your lot. 5.0 Special Circumstances:

5.1 In violation cases deemed dangerous, the lot owner or renter may be asked to appear before the GLOA BOD for review of non-conformance(s).
